Welcome to ArtComms. By accessing our website and using our services, you agree to be bound by these Terms of Service. Please read them carefully. If you do not agree with any part of these terms, you should not use our platform.
2. Nature of Our Platform
ArtComms serves as a venue to connect independent artists with clients looking for custom artwork. We provide the tools to manage commissions, track progress, and facilitate communication.
Important: We are not a party to any contract or transaction between artists and clients. We do not hire artists and we do not provide art services ourselves.
3. Financial Relationship
We do not handle money. ArtComms does not process payments, hold funds, or act as an escrow service. All financial transactions, including deposits, final payments, and refunds, are handled directly between the Artist and the Client through third-party payment providers agreed upon by both parties.
We are not responsible for:
- Failed payments or chargebacks.
- Refund disputes between users.
- Tax obligations resulting from income earned on the platform.
4. User Responsibilities
Users agree to use the platform professionally and respectfully.
- Artists: You are responsible for fulfilling accepted commissions in a timely manner and clearly communicating your terms of service to clients.
- Clients: You are responsible for providing clear requirements and paying artists according to the agreed-upon terms.
- You may not use the platform to distribute illegal content, hate speech, or malware.
5. Intellectual Property
Artists retain all intellectual property rights to their work unless explicitly transferred to the Client in a separate agreement. Clients are granted rights to use the artwork as agreed upon (e.g., personal use vs. commercial use).
6. Disclaimer of Warranties
The platform is provided on an "AS IS" and "AS AVAILABLE" basis. Because this is a free service, we make no express warranties or guarantees about the platform's reliability, availability, or suitability for your needs. We do not guarantee that the service will be uninterrupted or error-free.
7. Limitation of Liability
To the fullest extent permitted by law, ArtComms shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising out of your use of the platform or any interactions with other users.
